These Terms of Service govern all bookings, service agreements, and orders placed via this website (zurinaketola.com).

  • Service Provider: Zurina Ketola
  • Location: Berlin, Germany
  • Email: info@zurinaketola.com
  • Customer Category: The offerings on this website are available to both consumers (§ 13 BGB) and businesses (§ 14 BGB).

2. Nature of the Work & Disclaimer (Scope of Practice)

The sessions offered—including Usui Reiki, Tarot readings, and wellness coaching—are holistic, complementary practices intended for energetic balancing, relaxation, mindfulness, and personal reflection.

  • Non-Medical / Non-Psychiatric: The services offered are not medical, psychological, psychiatric, or licensed psychotherapeutic treatment.
  • No Diagnostic or Curative Claims: I do not diagnose, prescribe, treat, cure, or prevent any physical illness, injury, or psychiatric disorder. In accordance with German jurisprudence regarding spiritual healing (BVerfG, 1 BvR 784/04), clients are explicitly informed that energetic work does not replace conventional medical treatment.
  • Client Responsibility: You are encouraged to maintain any regular medical care and consultations with licensed physicians, therapists, or healthcare professionals. Any decisions made or actions taken following a session are your sole personal responsibility.
  • Tarot Readings: Tarot readings are offered for inspiration, personal reflection, and entertainment. They do not predict the future and are not a substitute for medical, psychological, legal or financial advice. Any decisions you make based on a reading remain your own responsibility.

3. Booking, Payment, & Contract Conclusion

  • The presentation of services on this website does not constitute a legally binding offer, but an invitation to book an appointment.
  • By selecting a date/time via the booking widget and completing checkout through Shopify Payments, you submit a binding contract to book the chosen service.
  • The contract is concluded immediately upon receipt of your payment and automated booking confirmation email.
  • Prices are listed in Euros (€) and include applicable statutory German taxes where required.

4. Appointment Fulfillment, Rescheduling, & Cancellation

The scheduling, cancellation, and refund conditions for all booked sessions are governed by the dedicated Cancellation & Refund Policy, which forms an integral part of these Terms.

  • Rescheduling or cancelling with at least 24 hours' notice before the scheduled appointment time is eligible for a full refund or date transfer.
  • Cancellations within 24 hours of the appointment time, late arrivals, and no-shows cannot be refunded, as the dedicated time and space have been reserved.

5. Right of Withdrawal (Widerrufsrecht)

Consumers have a statutory 14-day right of withdrawal for online contracts under German law. Full details regarding the exercise of this right, early expiry conditions under § 356 BGB for scheduled services, and the Model Withdrawal Form are detailed in the Cancellation & Refund Policy.

6. Liability Limitation

  • I am liable without limitation for intent, gross negligence, and any injury to life, body, or health resulting from a breach of duty.
  • In cases of slight negligence, liability is limited to the breach of essential contractual duties (cardinal duties)—duties essential to the proper execution of the contract and upon which you regularly rely. In such cases, liability is limited to typical, foreseeable damages at the time of contract conclusion.

7. Online Dispute Resolution & Consumer Arbitration

  • The European Commission provides an Online Dispute Resolution (ODR) platform for consumers: https://ec.europa.eu/consumers/odr.
  • I am neither obligated nor willing to participate in dispute resolution proceedings before a consumer arbitration board (Verbraucherschlichtungsstelle).

8. Governing Law & Jurisdiction

These Terms and all contracts concluded under them are governed exclusively by the laws of the Federal Republic of Germany, excluding the UN Convention on Contracts for the International Sale of Goods (CISG). For consumers, this choice of law applies only to the extent that it does not deprive the consumer of mandatory protection granted by the laws of the country where they have their habitual residence.
